The issues to be decided in this case are whether Respondent is liable for the violations charged in the NOV, whether Respondent should pay the penalties assessed in the NOV, and whether Respondent should be required to take the corrective actions demanded in the NOV.The pleadings, admissions, and affidavits showed there was no genuine issue of material fact and that Respondent is liable for failing to properly maintain and operate its stormwater facility.
