The issues are as follows: (a) whether Respondent violated Sections 562.11(1) (a) and 561.29 (1) (a), Florida Statutes,1 by selling an alcoholic beverage to Petitioner's undercover investigative aide on November 17, 2006; and (b) if so, what penalty, if any, should be imposed.Petitioner proved by clear and convincing evidence that Respondent sold an alcoholic beverage to a minor. Recommend a seven-day suspension and an administrative fine of $1000.
