01-003165PL  DEPARTMENT OF HEALTH, BOARD OF NURSING vs PETER DAWBER, R.N.  (2001)
Division of Administrative Hearings, Florida Filed: Aug. 13, 2001
The issues are whether Respondent, on or about October 2000, while employed by St. Joseph's Hospital, withdrew controlled substances (Demerol) from the Pysix system for patients and inaccurately and or incompletely documented the administration and or wastage of said medications, and, if so, what penalty is appropriate for Respondent's failure to conform to minimum standards of acceptable and prevailing nursing practice in violation of Subsection 464.018(1)(h), Florida Statutes.Respondent used personal access to withdraw controlled medication. Of total medication withdrawn, over 1,000 grams were unaccounted for--in records of patients as "waste." Violations proven by clear and convincing evidence.
02-000986  RICHARD W. HOLLAND vs DEPARTMENT OF MANAGEMENT SERVICES, DIVISION OF RETIREMENT  (2002)
Division of Administrative Hearings, Florida Filed: Mar. 12, 2002
Whether Petitioner was overpaid $961.87 in 1975 when he received a refund of his retirement contributions, and, if so, whether Petitioner is required to refund that amount to the Division of Retirement before receiving any retirement benefits.Evidence showed Petitioner was overpaid $961.87 in 1975, but neither statutes nor rules authorize agency to condition payment of retirement benefits related to current service upon refund of overpayment related to prior service.
