The threshold issue is whether, as a prerequisite to the operation of their foreclosure-related rescue business, Respondents were required to be licensed as mortgage brokers and as loan originators pursuant to chapter 494, Florida Statutes (2017).1/ A secondary issue is whether Respondents solicited, charged, received, or attempted to collect or secure payment for loan modification services without the borrower receiving a material benefit prior to being charged for services.The foreclosure-related rescue services provided by Respondents do not fall within the purview of chapter 494, and therefore complaint should be dismissed.
