The issue is whether Respondent engaged in an unlawful employment practice by discriminating against Petitioner on the basis of his race in violation of the Florida Civil Rights Act of 1992 ("FCRA").Respondent did not discriminate against Petitioner on the basis of his race in not hiring him when no positions were available at Respondent`s business.
