: The issues to be resolved in this proceeding concern whether the Division of Administrative Hearings and the Florida Commission on Human Relations (Commission) have subject matter jurisdiction of this dispute and, aside from the jurisdictional questions, whether the City of Cottondale has engaged in a discriminatory employment action against the Petitioner based upon her race (African-American).Petitioner failed to establish a prima facie case. She did not show she was qualified for the job, and that better-treated interviewees were similarly-situated as to qualifications. There is no jurisdiction, as city did not have 15 employees.
