The issues to be resolved in this proceeding concern whether the Respondent is guilty of conduct which warrants disciplinary action against him, pursuant to Section 231.36, Florida Statutes, as alleged in the Petitioner, Bill Williams, Superintendent of Education, School Board of Washington County's (School Board) petition for dismissal and whether the Respondent is guilty of conduct warranting disciplinary action, pursuant to Section 231.28, Florida Statutes, and Rule 6B-1.006, Florida Administrative Code, so as to justify revocation of his teaching certificate or a lesser penalty. Specifically, it must be determined, with regard to the School Board's prosecution, whether the Respondent committed misconduct in office, immoral conduct, or conduct unbecoming a teacher and, with regard to the prosecution by the Commissioner of Education, whether he has been guilty of gross immorality or an act involving moral turpitude, personal conduct which reduces his effectiveness as an employee of the School Board or has violated the rules of the State Board of Education.Petitioner's proved charges regarding gross immorality, act of moral turpitude, misconduct loss of effect, etc. because audiotape in evidence resolved credibility issue. conflicting witness
