The issue is whether Respondent violated Sections 943.13(7), 943.1395(6) and (7), Florida Statutes (2003),1 and Florida Administrative Code Rule 11B-27.0011(4)(a), and, if so, what discipline should be imposed.Petitioner failed to prove that Respondent sexually abused a child, and the spanking that he gave the child did not rise to the level of felony child abuse. Recommend dismissal of the Administrative Complaint.
