RECOMMENDED ORDER
After notice to the parties, a formal administrative hearing, pursuant to the Florida Administrative Procedures Act, was held in DeLand, Florida, on April 11, 1975, before Delphene Strickland, Hearing Examiner.

ISSUES
Whether subject signs should be removed for failure to secure current permits and for failure to keep signs in good repair.
FINDINGS OF FACT
No currents permits were secured for subject signs and said signs are in a poor and unsightly condition with damaged faces. Letters in the file show owner promised to refurbish subject signs on September 12, 1974 and also March 31, 1975. At date of hearing the sign was in the same unsightly condition. Notice of Violation was sent September 3, 1974.
CONCLUSIONS OF LAW
Signs without current permits and signs in unsightly conditions are in violation of state and federal law and are subject to be removed by the Department of Transportation.
RECOMMENDED ORDER
Remove signs within five (5) days of date of Final order.
