RECOMMENDED ORDER
By order entered January 17, 1985 the Motion to Dismiss filed by Respondent State of Florida, Department of Environmental Regulation, was granted, and Petitioner was afforded twenty (20) days from that date in which to file an amended petition which complies with the requirements of Section 28-5.201, Florida Administrative Code, and specifically Subsections (2)(b) and (e) thereof. That Order further provided that failure to timely file such an amended petition would result in a recommended order of dismissal.
To date, Petitioner has failed to file an amended petition or any other pleading or document in response to the January 17, 1985 Order. It is, therefore,
RECOMMENDED THAT:
A Final Order be entered dismissing with prejudice Petitioner's Request for Formal Proceeding Pursuant to Section 120.57, Florida Statutes.
