KIELY, O00 -O aK 7 Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF HEALTH, hereinafter referred to as “Petitioner,” files this Administrative Complaint before the Board of Speech Language Pathology and Audiology against PATRICIA M. KIELY, hereinafter referred to as “Respondent,” and alleges: 1, Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of Speech Language Pathology and Audiology pursuant to Section 20.43, Florida Statutes (Supp. 1996); Chapter 455, Florida Statutes; and Chapter 468, Florida Statutes. Pursuant to the authority of Section 20.43(3)(f), Florida Statutes (Supp. 1996), the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. U ) 2. Respondent is, and has been at all times material hereto, a licensed Speech Language Pathologist in the State of Florida, having been issued license number SA 0002099 3. Respondent’s last known address is Post Office Box 8698, Madison, Florida 33708. 4. On or about June 24, 1997, a Final Order in case number. 95-16258 was entered against Respondent. 5. The aforementioned Final Order included the term that Respondent was to pay Five Hundred dollars ($500.00) to the Board within thirty (30) days of the filing of the Final Order. 6. To date, Respondent has failed to pay said fine. 7. Based on the foregoing, Respondent is in violation of Section 468.1295(1)(g), Florida Statutes, by violating a lawful order of Board or Department previously entered in a disciplinary proceeding. WHEREFORE, Petitioner respectfully requests the Board of Speech Language Pathology and Audiology enter an Order pursuant to Chapter 468, Florida Statutes, and Rule 64B20-7.010, Florida Administrative Code, imposing one or more of the following penalties: revocation or suspension of Respondent’s license to practice Speech Language Pathology and Audiology, imposition of an administrative fine, issuance of a reprimand, U placement of the Respondent’s license on probation for a period of time and subject to-~ WY terms/conditions, and/or any other relief that the Board deems appropriate.
