ADMINISTRATIVE COMPLAINT Petitioner, TOM GALLAGHER, as Commissioner of Education, ‘files this Administrative Complaint against Shirley A. Williams . The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator's certificate pursuant to Sections 231.262 and 231.28, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth i in Sections 231.262(6) and 231.28(1), Florida Statutes. . The Petitioner alleges: JURISDICTION 1. _ The Respondent holds Florida Educator’s Certificate 589591, covering the areas of Emotionally Handicapped and Mentally Handicapped, which is valid through June 30, 2003. 2. - Atal times’ pertinent hereto, the Respondent was employed as a Exceptional Student ~ Education teacher at Riviera Middle School, in the Dade County School District. MATERIAL ALLEGATIONS 3. On or about December 16, 1996, Respondent was in an altercation with her boyfriend in the parking lot of her apartment complex. Respondent attacked hef boyfriend with two knives but. was disarmed. Respondent then damaged her boyfriend's car with her keys scratching it and marring the paint. Respondent was arrested and charged with Domestic Violence. Respondent was allowed - to enter a Pre-Trial Intervention Program and after it was completed the case was Nolle Prosequi by the court. Williams _, Administrative Complaint ; ‘Page 2 of 2 ee te Me ls a, STATUTORY VIOLATIONS 231.28(1)(c), Florida Statutes, in n that Respondent has een guilty of gross immorality or an an act : involving t moral ‘turpitude. - ; we Ae cil aim oe mr COUNT 2: The allegations of misconduct in vi ation of Section i 231.28(1)(f), Florida Statutes, in that Respondent, upon vestiga , has been found guilty of personal conduct which seriously reduces her effectiveness as an employee of the school board. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 231.262(6) and 231.28(1), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference.
