Stat. Respondent, Jefferson County (the “County”), as part of its 99-1-ER comprehensive plan amendment and pursuant to County Ordinance No. 99-08, adopted certain objectives and policies regarding siting and Permitting procedures for linear utilities. FPC filed the instant petition challenging said plan provisions. On April 25, 2000, the County filed a Suggestion of “Mootness with the Division of Administrative Hearings in this matter. The County advised that on April 20, 2000, through formal action by its Board of County Commissioners, it repealed County Ordinance No. 99-08, thereby rending the instant matter moot (inasmuch as Ordinance No. 99-08 never became final due to the filing of FPC’s petition). On April 27, 2000, Administrative Law Judge Donald R.
