ADMINISTRATIVE COMPLAINT | ; | COMES NOW the Petitioner, Department of Health, and files this Administrative : Complaint before the Board of Pharmacy against the Respondent, MAHESHKUMAR PATEL, R.PH., and in support thereof would state: 1. Petitioner is the state agency charged with regulating the practice of Pharmacy pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 465, Florida Statutes. the "Ag required by the Division of Medical Quelity A Assurance, councils or board, as appropriate, including the i issuance of emergency orders of : f suspension or restriction. “3, Respondent has been at all times p pertinent ‘hereto, a duly Ticensed pharmacist pursuant to Chapter 465, Florida Statutes, having been issued license number PS - 0031788. A i es, Bia. iw . led 4. Respondent's last known address is 3614 Landings Way, Apartment #10, Tampa, Florida 33624. 5. An inspection was performed by agents of the Petitioner. As a result, it was discovered that on May 24, 1999 the Respondent misfilled a prescription refill submitted by G.G. for S.S., for the medication Effexor 37.5 mg., by dispensing Effexor 75mg. 6. On July 27, 1999, the Respondent admitted to misfilling the prescription on May 24, 1999 for S.S.. 7. The conduct of the Respondent as aforesaid is contrary to the provisions contained in Section 465.016(1)(e) and 465.016(1)(g), Florida Statutes by using in the compounding of a prescription, or furnishing upon prescription, an ingredient or article _ different in any manner from the ingredient or article prescribed, except as authorized in s. 465.019(6) or 465.025.
