ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, and files this Administrative Complaint before the Board of Pharmacy, against the Respondent, HARRY HORODECK, and in support thereof would state: . 1. Petitioner is the state agency charged with regulating the practice of pharmacy, pursuant to Section 20.43, Florida Statutes, Chapter 455, Florida Statutes; and Chapter 465, Florida Statutes. 2. Respondent has been at all times pertinent hereto, a duly licensed pharmacist pursuant to Chapter 465, Florida Statutes, having been issued license number PS 0012646, Respondent’s last known address is 1806 Dolphin Boulevard, St. Petersburg, Florida 33707. | 4. On or about July 28, 1999 the Respondent, while employed as a pharmacist with Walgreens Pharmacy located at 10410 Roosevelt Boulevard North, St. Petersburg, Florida 33715, was observed self-medicating by taking and ingesting Acetaminophen with Codeine. At the time that the Respondent ingested the medication as aforesaid, he did not have a valid prescription. = contained in Section 465.016(1)(i), Florida ‘Statutes by dispensing or distributing a controlled substance other than in the course of the professional practice of pharmacy and Section 893.04(1), Florida Statutes, for dispensing controlled substances without a written or oral prescription of a practitioner.
