ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing . Board, against RICHARD R. REISELT, ("Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of contracting Pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. 2. “Respondent is, , and has been at all times material hereto, a Certified Building Contractor and a Certified Pollutant Storage Systems Contractor, in the State of Florida, having been issued license numbers CB C052148 and PC C054948, respectively. 3. Respondent's last known address i is Post Office Box 770489, Orlando, Florida, 32877. 4. At all times material hereto, Respondent was licensed to engage in the practice of bo . vw - ws contracting in his individual capacity. . 5. In his individual capacity, the Respondent was responsible for supervision of all operations of the business; for all field work at all sites; and for financial matters, both for the business in general and for each specific job. 6. Onor about August 20, 1996, the Respondent completed a permit application with the City of Greenacres Engineering and Building Department for exterior work to be performed at the Cumberland Farms store located at 5245 10th Avenue North, City of Greenacres, Florida. 7. Based on the permit application described in paragraph six (6) above, on or about August 28, 1996, the City of Greenacres Engineering and Building Department issued permit number B96-1716, by and through Respondent’s licensure, for the exterior work to be performed - at 5245 10th Avenue North, City of Greenacres, Florida. . 8. On or about November 19, 1996, the City of Greenacres filed a Notice of Additions or Corrections for the work performed at 5245 10th Avenue North. 9. Said notice required that all work stop and that the work be completed in accordance with stamped plans. Alternatively, the notice provided that the Respondent could Tesubmit new d drawings | for the work performed. — 10. On or about July 15, 1997, the Construction Industry Licensing Board of Palm . Beach County issued 4 a Notice of Violation to the Respondent for failing t to obtain necessary inspections with regard to work performed under permit no. B96-1716 at 5245 10th Avenue North, City of Greenacres, Florida. . 11. The notice referenced in paragraph ten (10) above required the Respondent to complete the inspection process for work performed under permit no. B96-1716 no later than August 15, 1997. 12. . Respondent failed to take the necessary corrective measures by failing to obfdin all necessary inspections for work performed under permit no. B96-1716. COUNT I 13. Petitioner realleges and incorporates the allegations set forth in paragraphs one through twelve as though fully set forth in this Count I. 14. Based on the foregoing, the Respondent violated Section 489.129(1)(p), Florida "Statutes (1993), by proceeding on any job without obtaining applicable local building department permits and inspection. | COUNT TT 15. Petitioner realleges and incorporates the allegations set forth in paragraphs one . through five as though fully set forth in this Count I. 16. On or about August 20, 1996, the Respondent completed a permit application with the City of Greenacres Engineering and Building Department for exterior work to be performed at the Cumberland Farms store located at 6701 Lake Worth Road, City of Greenacres, Florida. 17. Based on the permit application referenced in paragraph sixteen (16) above, on or about August 28, 1996, the City of Greenacres Engineering and Building Department issued permit number B96-1715, by and through Respondent’s licensure, for exterior work to be performed at 6701 Lake Worth Road, City of Greenacres, Florida. 18. On or about July 15, 1997, the Construction Industry Licensing Board of Palm Beach County issued a Notice of Violation to the Respondent for failing to secure required inspections for work performed under permit no. B96-1715 at 6701 Lake Worth Road, City of - oe De 9 | W | Ww Greenacres, Florida, . 19. The-notice referenced in paragraph eighteen (18) above required the Respondent to complete the inspection process for work performed under permit no. B96-1715 no later than August 15, 1997. | 20. Respondent failed to take the necessary corrective measures by failing to obtain the necessary inspections for work performed under permit no. B96-1715. 21. Based on the foregoing, the Respondent violated Section 489.129(1)(p), Florida : ‘Statutes (1993), by proceeding on any job without obtaining applicable local building department _ permits and inspection. . ae WHEREFORE, Petitioner * respectly requests the Construction Indust Licensing ) Board enter an on Order in imposing ‘one or more of. the following penalties: ‘place on probation, reprimand the licensee, revoke, suspend, deny the i issuance or renewal of the certificate or .
