Petitioner is the state agency charged with regulating the practice of electrical contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. te. At all times aoa hereto, Respondent was duly licensed to engage in the practice of cletial contracting in the State of Florida pursuant to Chapter 489 Part Il, Florida Statutes, having been issued license number EC 0000405. . wha . 3. . Respondent’s address of record is 1010 East 47" Street, Hialeah, Florida, 33013. WG —. 4. At all times material hereto, Respondent was the licensed qualifier for Jobalco Electric, Inc. and was responsible in such capacity for all field and financial matters associated with that business. 5. On or. about October 25, 1999, Petitioner received a complaint from Martin Anderson (“Anderson”) stating that Anderson received a business card that displayed the name Pro Star and advertised the sale of security systems. 6. The card listed Respondent’s license number as the qualifying agent’s license number for Pro Star. 7. At no time material hereto, was Respondent the licensed qualifier for Pro Star. 8. Based on the foregoing, the Respondent violated Section 489.533(1)(), Florida Statutes, by acting in the capacity of a contractor under any certificate or registration issued hereunder except in the name of the certificateholder or registrant as set forth on the issued certificate or registration or in accordance with the personnel of the certificateholder or registrant as set forth in the application for the certificate or registration or as later changed as provided in this part. WHEREFORE, Petitioner respectfully requests the Electrical Contractors’ Licensing Board enter an Order i imposing one or more of the following penalties: Place ¢ on Probation, reprimand the licensee, revoke, “suspend, ‘deny. the issuance or renewal of the certificate or registration, require correction, impose an administrative fine not to exceed $5, 000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other’ yr NO, 7 +) 2 J relief that the Board ig authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder. ) ~) Signed this Y day of IG ? h / C , 2000.
