comes NOW, the Department of Business and Professional Regulation, Division
|
of Hotels and Restaurants (hereinafter referred to as “Division") files this administrative
complaint against NAPLES GO CART, INC. (hereinafter referred to as "Respondent'). The
Division seeks to impose disciplinary action upon the Respondent and alleges:
| 1. The Division has jurisdiction over the subject matter of, and the parties to,
this proceeding pursuant to Chapter 509, Florida Statutes.
| 2. At all times relevant to the facts alleged in this administrative complaint,
Respondent held a license number: 21-01907-R for the operation of a public food service
establishment. Respondent's last known address of record is 5400 TREE TOPS DRIVE,
NAPLES, FL 34113.
| 3. Petitioner seeks to revoke; suspend; impose administrative fines; impose a
civil penalty; require corrective action, and additional or other penalties as may be
provided for by law or rule, or any combination thereof.

4. Petitioner realleges and incorporates by reference, as if fully stated
herein, the allegations contained in paragraphs 1 through 2, above.
$. The factual allegations and charges are specifically set forth in the attached
Exhibit A, incorporated by reference in this administrative complaint as if fully and
complétely restated herein. Each listed violation is a separate charge.
WHEREFORE, the Division of Hotels and Restaurants hereby charges the
Respandent with the above counts and notices its intention to seek imposition of an
appropriate penalty of revocation; suspension; administrative fines; civil/administrative
penalty corrective action, additional or other penalties as may be provided for by law or
rule, or any combination thereof.

It is alleged that on August 26 & September 9, 1999 the licensee was in violation of Florida Statute 509 and/or the Rules of
the Division of Hotels and Restaurants, Florida Administrative Code, in the following particulars:
1. 745-5) | NFPA 10, 1-5.3 [High] hazard ... locations ... consist of ... cooking areas. [These locations shall
be NEPA 10, 3-5 protected by the installation of portable fire extinguishers with
a minimum rating of] 40-B:C provided within 30 feet of the hazard.
OBSERVED NO 40 BC FIRE EXTINGUISHER ON SITE.
2. *45-23 61C-1.004(9)(b) FAC A standard state approved service tag shall be attached to each extinguisher and a
: person holding a valid state permit issued by the State Fire Marshal shall
recharge or inspect the extinguisher and shall prepare the tag to include the
information required by rule 4A-21.241, FAC, herein adopted by reference.
OBSERVED NO INSPECTION TAG ON 2A10BC FIRE EXTINGUISHER.
3. ¥45-18 : NEPA 96, 8-2.1 An inspection and servicing of the fire extinguishing system and listed exhaust
: hoods containing a constant or fire-actuated water system shall be made at least
every 6 months by properly trained and qualified persons.
: OBSERVED NO CURRENT INSPECTION REPORT FOR AUTOMATIC
! FIRE SUPPRESSION SYSTEM.
4.*50-1 61C-1.002(6) FAC Renewal - It is the responsibility of the licensee to renew the license prior to
: the expiration date. Any public ... food service establishment operating on an
expired license is deemed to be operating without a license, and subject to the
penalties provided for this offense in law and rule. ..
OBSERVED NO CURRENT LICENSE, PER OUT RECORDS NOT
RENEWED FOR TWO YEARS.
