ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as “Petitioner,” files this Administrative Complaint before the Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling against NAOMI S. KORN, LCSW, hereinafter referred to as “Respondent,” and alleges: 1. Petitioner is the state agency charged with regulating the practice of clinical social work pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 491, Florida Statutes. ; 2. Pursuant to the authority of Section 20.43 (3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration, hereinafter referred to as the “Agency,” to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. 3. Respondent is and has been at all times material hereto, a Clinical Social Worker, MZ, : licensed in the State of Florida, having been issued license number Sw 568. 4. The address of record of the Respondent is 205 20" Avenue Northeast, St. Petersburg, Florida a7 5. From approximately May of 1999 through August of 1999, the Respondent provided therapeutic services to patient SS. 6. SS presented with complaints related to long-term post-traumatic stress disorder; the Respondent noted that $$ exhibited possible borderline personality features. 7. The thitial treatment an developed by the Respondent included weekly individual sessions of fifty minutes; a referral for inpatient psychiatric hospitalization; and use of EMDR. - 8. Although the Respondent recommended inpatient psychiatric hospitalization for SS, the Respondent did not make a referral to a psychiatrist. 9. The requisite standard of care for a social worker presented with a patient with this type of psychopathology requires that the social worker refer the patient for psychiatric evaluation (including assessment for medication). Based on the foregoing, the Respondent has violated section 491.009 2\(s), Florida Statutes, by failing to meet the minimum standards of performance in' professional activities when measured against generally prevailing peer performance. WHEREFORE, Petitioner respectfully requests the Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling to enter an order imposing one or more of the following penalties: revocation or suspension of the Respondent’s $2, license; restriction of Respondent’ s practice; imposition of an administative fine; i i \ 4 i issuance of a reprimand, placement of the Respondent’s license on probation for a period of time and subject to te Ahd/or conditions determined by the Board; and/or any relief rm that the Board deems appropiate.
