DOMINIC VARA AND PALM BEACH 200084358 REALTY GROUP, INC. 200181131 200180140 Respondents. / ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against T. Dominic Vara and Palm Beach Realty Group, Inc. (“Respondents”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent T. Dominic Vara is and was at all times material hereto a licensed Florida real estate salesperson, issued license number 0677429 in accordance with Chapter 475 of the Florida Statutes. The last license issued was as an active salesperson c/o Palm Beach Realty Group, Inc., 127 Courtnay Court. Jupiter, Florida 33458. FDBPR vs T. Dominic Vara FDBPR Case N° 200181129 Adrinistrative Complaint 3. Respondent Palm Beach Realty Group, Inc, is and was at all times material hereto a corporation registered as a Florida real estate broker having been issued license number 1010224 in accordance with Chapter 475 of the Florida Statutes. The last license issued was at the address of 127 Courtnay Court, Jupiter, Florida 33458. 4. While licensed as a salesperson, Respondent was registered as a vice-president and sole signatory on the account of Respondent Palm Beach Realty Group, Inc. A copy of the bank form and Secretary of State form is attached hereto and incorporated herein as Composite Exhibit |. 5. Between January 5, 2001 and January 17, 2001, Respondent Palm Beach Realty Group, Inc. was inactive due to no qualifying broker. 6. On February 2, 2001, Petitioner conducted an office inspection and audit of Respondent’s accounts. Al that time, Respondent stated that he was not holding any escrowed monies. A copy of the audit form is attached hereto and incorporated herein as Exhibit 2. 7. Onor about January 4, 2001, approximately one month prior to the audit, Respondent, as escrow holder, received a check and bank wire transfer, in the amount of $28,000, pursuant to a purchase and sale contract. A copy of the contract, check and wire transfer is attached hereto and incorporated herein as Composite Exhibit 3. 8. Onor about February 27, 2001, the buyers in this transaction signed an addendum to the purchase and sale contract releasing the deposit to the closing agent. The sellers also signed a similar addendum releasing the deposit to the closing agent. A copy of the addenda to contract for sale and FDBPR vs T. Dominic Vara FDBPR Case N° 290181123 Administrative Complaint purchase is attached hereto and incorporated herein as Exhibit 4. 9, By letter dated March 23, 2001, the closing agent for the transaction made a demand on the deposit. A copy of the letter is attached hereto and incorporated herein as Exhibit 5 10. By letter dated March 28, 2001, Respondent admitted to Petitioner that he was holding the deposit in question. A copy of the letter is attached hereto and incorporated herein as Exhibit 6. 11. By letter dated March 28, 2001, Petitioner’s investigator demanded that Respondents produce copies of ull reconciliations, bank statements and all documents related to the above- mentioned transaction. A copy of the letter is attached hereto and incorporated herein as Exhibit 7. 12. Respondent failed to comply with Petitioner's demand. Consequently, on or about April 2, 2001, Petitioner issued a subpoena for the bank records of Respondent Palm Beach Realty Group, Inc. A copy of the subpoena is attached hereto and incorporated herein as Exhibit 8. 13. The bank records revealed the above-mentioned wire transfer and deposit and many subsequent withdrawals resulting in a negative balance of $532.46 by the end of January, 2001. A copy of the bank records is attached hereto and incorporated herein as Exhibit 9. 14. On or about March 27, 2001, Respondent opened a different account in the name of Respondent Palm Beach Realty Group, Inc. and deposited $28,300.00. A copy of the bank records is attached hereto and incorporated herein as Exhibit 10. 15. The bank records showed a $28,000.00 wire transfer out of that account into the account of Respondent’s attorney on or about April 18, 2001. See Exhibit 10. FDEPR vs T. Dominic Vara FDBPR Case N° 200181123 Administrative Complaint 16. Respondent released the deposit for the transaction approximately one month after the closing agent made the demand and ten days before the scheduled closing. COUNT | Based upon the foregoing, Respondent T. Dominic Vara is guilty of having operated as a salesperson without a registered cmployer in violation of Section 475.42(1)(b), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. COUNT II Based upon the foregoing, Respondent Palm Beach Realty Group, Inc. is guilty of failure to have a current registration with an active broker with the Petitioner in violation of Rule 61J2-5.019 of the Florida Administrative Code and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. COUNT II Based upon the foregoing, Respondent T. Dominic Vara is guilty of having been registered as an officer of the corporation while licensed as a salesperson in violation of Rule 61J2-5.016 of the Florida Administrative Code and, therefore, in violation of Section 475.25(1)(e) Florida Statutes. COUNT IV Based upon the foregoing, Respondent Palm Beach Realty Group, Inc. is guilty of failure to list broker as a signatory on the escrow account in violation of Rule 61J2-14.010 of the Florida Administrative Code and, therefore, in violation of Section 475.25(1)(e), Florida Statues. Dominic Vara is guilty of fraud, misrepresentation, dishonest dealing by trick, scheme or device, culpable negligence, or breach of trust in ary business transaction in violation of Section 475.25(1)(b), Florida Statutes. COUNT VI Based upon the foregoing, Respondent Palm Beach Realty Group, Inc. is guilty of fraud, misrepresentation, dishonest dealing by trick, scheme or device, culpable negligence, or breach of trust in any business transaction in violation of Section 475.25(1)(b), Florida Statutes. COUNT VIE Based upon the foregoing, Respondent T. Dominic Vara is guilty of failure to account or deliver funds in violation of Section 475.25(1)(d)1., Florida Statutes. COUNT VUI Based upon the foregoing, Respondent Palm Beach Realty Group, Inc. is guilty of failure to account or deliver funds in violation of Section 475.25(1)(d)1., Florida Statutes. COUNT Ix Based upon the foregoing, Respondent Palm Beach Realty Group, Inc. is guilty of failure to maintain trust funds in the real estate brokerage escrow bank account or some other proper depository until disbursement thereof was properly authorized in violation of Section 475.25(1)(k), Florida Statutes. FDBPR vs T. Dominic Vara FDBPR Case N° 200181129 Administrative Compiaint COUNT X Based upon the foregoing, Respondent T. Dominic Vara is guilty of failure to maintain trust funds in the real estate brokerage escrow bank account or some other proper deposttory until disbursement thereof was properly authorized in violation of Section 475.25(1)(k), Florida Statutes. COUNT XI Based upon the foregoing, Respondent T. Dominic Vara is guilty of having obstructed or hindered in any manner the enforcement of Chapter 475, Florida Statutes or the performance of any lawful duty by any person acting under the authority of Chapter 475, Florida Statutes in violation of Section 475.42(1)(i), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. COUNT XII Based upon the foregoing, Respondent T. Dominic Vara is guilty of having knowingly concealed any information relating to violations of Chapter 475, Florida Statutes. in violation of Section 475.42(1)(1), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. ESSENTIAL ALLEGATIONS OF MATERIAL FACT 17. Petitioner realleges all facts contained in paragraphs one through three of this Administrative Compliant and incorporates them into this set of allegations. 18. On or about April 5, 1999, Respondent Vara submitted to Petitioner an application for FDBPR vs T. Dominic Vara FDBPR Case N* 200181123 Administrative Complaint licensure as a real estate salesperson. A copy of the application is attached and incorporated as Exhibit 11. 19. On the application, Respondent Vara signed a sworn affidavit which stated: The above named, and undersigned, applicant for licensure as real estate salesperson under the provisions of Chapter 475, Florida Statutes, as amended, upon being duly sworn, deposes and says that s(he) is the person so applying, that s(he) has carefully read the application, answers, and the attached statements, if any, and that all such answers and statements are truc and correct, and are as complete as his/her knowledge, information and records permit, without any evasions or mental reservations whatsoever. | 20. Question 9 of the application asked whether Respondent had “ever been convicted ofa crime, found guilty, or entered a plea of guilty or nolo contendere (no contest), even if adjudication was withheld.” | 21. To question 9 of the application, Respondent replied “Yes” and disclosed a 1996 DUL 22. Inreliance upon Respondent’s application, Petitioner issued a real estate salesperson’s license to Respondent Vara. 23. Respondent Vara failed to disclose the following: A. Onor about September 19, 1988, in St. Lucie County, Respondent entered a plea of nolo contendere to Possession of Marijuana. A copy of the court documents is attached hereto and incorporated herein as Exhibit 12. B. On or about December 19, 1990, in Martin County, Respondent entered a plea of FDBPR vs T. Dominic Vara FDBPR Case N° 200281129 Administrative Complaint guilty/nolo contendere to Resisting an Officer without Violence and Possession of Marijuana. A copy of the court documents is attached hereto and incorporated herein as Exhibit 13. C. On or about May 20, 1991, in Orange County, Respondent entered a plea of guilty to Disorderly Intoxication and Resisting Officer without Violence. A copy of the court documents is attached hereto and incorporated herein as Exhibit 14. D. Onor about August 26, 1991, in Indian River County, Respondent entered a plea of nolo contendere to Assault, Possession of Marijuana and Possession of Drug Paraphernalia. A copy of the court documents is attached hercto and incorporated herein as Exhibit 15. E. On or about April 15, 1994, in Orange County, Respondent entered a plea of nolo contendere to Driving Under Influence. A copy of the court documents is attached hereto and incorporated herein as Exhibit 16. F. On or about July 28, 1999, in Palm Beach County, Respondent was adjudicated guilty of Reckless Driving. A copy of the court documents is attached hereto and incorporated herein as Exhibit 17. COUNT XIII Based upon the foregoing, Respondent T. Dominic Vara has obtained a license by means of fraud, misrepresentation, or concealment in violation of Section 475.25(1)(m), Florida Statutes. COUNT XIV Based upon the foregoing, Respondent T. Dominic Vara has failed to comply with the FDBPR vs T. Dominic Vara FDBPR Case N° 2009181129 Administrative Complaint requirements of Rule 6152-2.027(2) of the Florida Administrative Code and, therefore, is in violation of Section 475.25(1)(e), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand, imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant or permitee to complete and pass additional real estate education courses; publication; or any combination of the foregoing which may apply. See § 475.25(1), Fla. Stat. (1999) and Fla. Admin. Code R. 6152-24.001. The penalties which may be imposed for violation(s) of Chapter 455 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license, registration, or permit; suspension of the license, registration, or permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense, imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or permitee to complete and pass PDEPR vs T.
