Lewis Jacobs Respondent ADMINISTRATIVE COMPLAINT RONALD BLOCKER, as Superintendent of Schools, for and on behalf of the Schoo! Board of Orange County, Florida, (hereinafter referred to as “Petitioner’), files this Administrative Complaint against Lewis Jacobs (hereinafter referred to as “Respondent’). Petitioner seeks the severance of Respondent's professional services contract with Petitioner pursuant to Section 1012.33, Florida Statutes. The Petitioner alleges: 1. The Respondent, at all times material to this Complaint, was employed as a classroom teacher by the Petitioner, the School Board of Orange County, Florida. 2. The Respondent, holds a professional services contract of employment with the School Board of Orange County, Florida. 3. That on or about January 13, 1992, Respondent, Lewis Jacobs received a written reprimand for inappropriate use of physical farce towards students. 4, That on or about January 30, 1995, Respondent Lewis Jacabs received a letter of reprimand from the Education Practices Commission for inappropriate disciplinary methods. 62/12/2883 9:24 OCPS EMPLOYEE RELATIONS » 3331 NO. 355 That on or about August 11, 2000, the Respondent was issued written directives following a confrontation with an inmate student at the Orange County Correctional Facility. These directives instructed the Respondent to conduct himself in a professional manner at all times while interacting with student staff and the community. That on or about October 28, 2002, a student in the Respondent class stated she was going to commit suicide. The School Resource Officer spoke to the student who clalmed she was just joking. In her statement to police, the student stated she had been seeing the Respondent after hours and he had discontinued the relationship. The student stated she was just trying to get his attention. That on or about November 6, 2002, another student in the Respondent's class told administration that the Respondent had inferred to the class that she and the Respondent had some type of personal relationship. She also stated that the Respondent asked her if she used hot oil on her legs and would she allow him to assist her. That on or about November 19, 2002, the Respondent submitted written responses to the two allegations. The Respondent admitted to meeting the student “one Saturday” where the Respondent and the student “concluded that it would not be in the best interest of either of us, to see each other again". The Respondent stated that his reference to the other student was meant to imply that she already had a boyfriend {not the Respondent) and the discussion regarding waxing her legs was “strictly far the purposes of maintenance”. Such actions by the Respondent are in violation of School Board Policies and constitute misconduct in office, willful neglect of duty, gross insubordination, conduct unbecoming a public employee, and a breach of Respondent's employment agreement with the School Board. Said violations are sufficient grounds to sever the professional services contract status of Respondent, Lewis Jacobs, and to terminate his employment with the School Board of Orange County, Florida. THEREFORE, the Superintendent of Schools for the School Board of Orange County, Florida, recommends that the Board sever its professional services contract relationship with the Respondent and terminate immediately the employment of Respondent, Lewis Jacobs.
