ADMINISTRATIVE COMPLAINT The State of Florida, Office of Financial Regulation, (“Office”) files this Administrative Complaint against Trinity Financial Services, LLC (“Trinity”), alleging: GENERAL ALLEGATIONS ie Pursuant to section 494.0011, Florida Statutes, the Office is charged with administering and enforcing the provisions of Chapter 494, Florida Statutes. 2. Pursuant to section 494.00255(1), Florida Statutes, failure to comply with any listed provision of 494.00255(1)(a) through (y), Florida Statutes, constitutes grounds for disciplinary action. 3. Section 494.00255(1)(u), Florida Statutes, specifies failure to comply with any provision of sections 494.001 through 494.0077, or any rule or order made or issued pursuant to sections 494.001 through 494.0077, Florida Statutes, is a violation that constitutes grounds for disciplinary action. 4. At all times material hereto, Respondent Trinity Financial Services, LLC is or was a mortgage lender as defined in section 494.001(23), Florida Statutes, and holds license number MLD1354. a: Respondent’s designated mailing address of record is 2618 San Miguel Drive, Suite 30, Newport Beach, CA 92660. 6. As a matter of course, the Office regularly reviews submissions due from licensees. 7. Pursuant to section 494.0063, Florida Statutes, each mortgage lender business shall submit annual audited financial statements to the Office within 120 days of the licensee’s fiscal year end. 8. As part of its application for license, Respondent reported to the Office that its fiscal year ends on December 31 of each year. 9. In violation of section 494.0063, Florida Statutes, Respondents failed to timely submit its audited financial statement for its fiscal year ending on December 31, 2016. 10. The audited financial statement was last due on April 30, 2017, but has not been submitted to the Office. 11. Pursuant to section 494.00255(2), Florida Statutes, violation of any act specified in section 494.00255(1), Florida Statutes, may result in reprimand, license suspension, license revocation, denial of a license, or imposition of a fine up to $25,000 for each count or separate offense. 12; Rule 69V-40.111, Florida Administrative Code, and Form OFR-494-14, provides the disciplinary guidelines for statutory violations. The maximum penalty for violation of section 494.063, Florida Statutes, is a fine in the range of $3,500 to $7,500 and, or, license revocation. Rule 69V-40.111(3), Florida Administrative Code, and Form OFR-494-14(75). WHEREFORE, Respondent is hereby notified that the Office intends to enter an Order imposing an administrative fine of $7,500 and revoking Respondent’s license, MLD1354.
