McKay Scholarships for Students with Disabilities Program and the Florida Tax Credit Scholarship Program is being revoked. The reasons for the revocation and means to challenge this decision are identified therein. Once the referenced administrative action becomes final, parents of enrolled scholarship students will be notified of your school’s ineligibility to participate in the scholarship program. Scholarship students will be required to transfer to another participating private school to maintain scholarship eligibility. Connecting Generations and Nations Academy (6346) Agency Case Number: DOE-2018-3621 Florida Department of Education (Department) records indicate Connecting Generations and Nations Academy (6346) (CGNA) is a private school participating in the John M. McKay Scholarship for Students with Disabilities Program and the Florida Tax Credit Scholarship Program, providing services to eligible students pursuant to sections 1002.39, 1002.395, 1002.42, and 1002.421, Florida Statutes. For the following reasons, the Department is immediately suspending McKay and FTC payments and revoking CGNA’s eligibility to participate therein: 1. CGNA, in employing one Nadine Price, employs an employee or contracted person who has failed a background screening given pursuant to section 943.0542, Florida Statutes, after having been notified of such failure. Specifically, Ms. Price has failed the portion of the screening prescribed by section 435.04(2)(jj), Florida Statutes, relating to her entry of a plea of nolo contendre regarding charges of contributing to the delinquency of a minor. Pursuant to section 1002.421(2)(i)(3), Florida Statutes, CGNA is therefore ineligible for continued scholarship participation. 2. CGNA has failed to disclose to the Department the nature of the employment of Nadine Price, whom CGNA employs as the school’s owner, director, and/or chief administrative officer. In so doing, CGNA has failed to notify the Department of a change in the school’s owner, director, or chief administrative officer, thereby violating sections 1002.39(8)(a), 1002.395(8)(a), 1002.42(2)(c)(1), 1002.42(2)(e), 1002.421(1), and 1002.421(2)(c), Florida Statutes. 3. CGNA, in consideration of its employment relationship with Nadine Price, is operating an educational institution contrary to the health, safety, or welfare of students and the public, as contemplated in sections 1002.39(7) and 1002.395(11), Florida Statutes. Sections 1002.39(7)(a) and 1002.395(11)(a), Florida Statutes, provide that the Commissioner of Education may revoke a private school’s program participation if the school: fails to comply with the provisions of either section; fails to comply with the requirements of section 1002.421, Florida www.fidoe.org 325 W. Gaines Street | Tallahassee, FL 32399-0400 | 850-245-0505 Statutes; fails to comply with the requirements of section 1002.42, Florida Statutes; or operates an educational institution contrary to the health, safety and welfare of the public. Additionally, sections 1002.39(7)(c) and 1002.395(11)(c), Florida Statutes, state the Commissioner may immediately suspend payments to a school in the event of a threat to the health, safety and welfare of the students. Accordingly, any and all scholarship payments to CGNA are immediately suspended, and CGNA’s eligibility to participate in state funded scholarship programs is hereby revoked. NOTICE OF RIGHT TO APPEAL Pursuant to sections 120.569, 120.57, 1002.39(7), and 1002.395(11), Florida Statutes you are entitled to dispute this decision through legal administrative procedures and to be represented by counsel or other qualified representatives. If you wish to do so, you must make a written request for an administrative hearing in accordance with the provisions of Chapter 28-106, Florida Administrative Code. The written request must be received by the Department’s agency clerk within 15 calendar days of the date you receive this letter.
