Order re: JOINT STIPULATION TO STAY AND DISMISS

Plaintiff and Counter-Defendant Quantum Corporation and Defendant and Counter-Plaintiff Crossroads Systems, Inc. ("the Parties"), stipulate and agree as follows:

WHEREAS the Parties reached a binding settlement during a settlement conference before Magistrate Judge Sallie Kim;

WHEREAS the terms of the settlement were placed on the record at that settlement conference (D.I. 182); and

WHEREAS the written form of the settlement agreement has not yet been finalized; therefore,

IT IS HEREBY STIPULATED by and among the parties to this action through their counsel that the above-captioned action should be STAYED until December 11, 2015, at which point all claims shall be dismissed with prejudice.

The Parties agree that Magistrate Judge Sallie Kim shall retain jurisdiction to resolve any disputes over the written form of the settlement agreement, which shall be submitted to her by December 4, 2015.

The Parties agree that they shall each bear their own costs, expert fees, attorneys' fees and other fees incurred in connection with this matter.

IT IS SO STIPULATED, through Counsel of Record.

PURSUANT TO STIPULATION, IT IS ORDERED that the forgoing Agreement is approved.
