SUPPLEMENTAL JOINT CASE MANAGEMENT STATEMENT

Plaintiffs MICHAEL A. RUSSELL JR. and JONATHAN SASSANI ("Plaintiffs") and Defendants SYNTHES, INC.; DEPUY SYNTHES SALES, INC.; JOHNSON & JOHNSON SERVICES, INC.; and SYNTHES USA SALES, LLC ("Defendants") (collectively, the "Parties") hereby submit this Supplemental Case Management Statement.

The Parties have reached settlement. On November 23, 2015, Plaintiffs each filed a Notice of Acceptance of Defendants' Rule 68 Offer of Judgment. The Parties have come to a mutual agreement regarding Defendants' payment of attorneys' fees and costs to Plaintiffs.

The Parties will promptly file a joint stipulation of judgment with this Court. The Parties do not anticipate that any conflicts or issues will arise that will require the Court's attention prior to filing the joint stipulation of judgment.

IT IS SO ORDERED that the CMC is reset from 12/17/15 to 1/28/16 at 9:30 A.M. An updated joint CMC Statement shall be filed by 1/21/16. The 1/28/16 CMC will be vacated once a stipulation for dismissal is filed.
