HEARING OFFICER'S REPORT


Pursuant to notice, the Division of Administrative Hearings, by its duly designated hearing officer, G. Steven Pfeiffer, held a public hearing in this case on September 2, 1975, at Lake Butler, Florida. The following appearances here entered:

Wayne Carroll, Lake Butler, Florida, for the Public Employer Cynthia Broward, Lake Butler, Florida, for the Union

County Teacher's Organization.


Ralph Walker, Lake Butler, Florida, for the Union County Professional Organization.


SUMMARY OF THE CASE


The Union County Teachers Organization filed a petition with the Public Employees Relations Commission on February 25, 1975. A hearing was conducted on April 7, 1975; however, subsequent to the holding of the hearing the court reporter lost her notes, and the hearing was rescheduled. At the hearing on September 2, the Union County Professional Organization appeared through its former president and announced that it had dissolved in accordance with a vote of its membership, and wished to withdraw its Motion to Intervene. The withdrawal was allowed.


The parties entered into the following stipulations:


  1. The Union County School Board is a Public Employer within the meaning of Florida Statutes, 447.002(2).


  2. The Union County Teachers Organization is an employee organization within the meaning of Florida Statutes, 447.002(10).


  3. The Union County Teachers Organization properly requested recognition as the exclusive bargaining agent of the employees in the unit described in the petition.


  4. There is no contractual bar to holding an election in this case.

  5. There is no pertinent collective bargaining history which would affect the holding of an election in this case.


  6. The Union County Teachers Organization is properly registered with the Public Employees Relations Commission.


  7. The Union County Teachers Organization has made a proper showing of interest.


  8. The collective bargaining unit should include the following: instructional personnel holding valid State of Florida teaching certificates, rank III or above, and under contract to or otherwise employed by the school board of Leon County.


The following positions should be excluded from the collective bargaining unit: non-public personnel, managerial personnel, confidential personnel, administrative personnel, supervisory personnel, substitute teachers, and deans.


In accordance with Florida Statutes, 447.009(3)(a), no recommendations are submitted.
