RECOMMENDED ORDER


This matter was brought up for final hearing at 2:00 p.m., September 10, 1975, Room 250A, Hillsborough County Courthouse, Tampa, Florida, on charges filed by the Board of Nursing seeking to revoke the license of the Respondent, Carol Ann Borischak. Ms. Borischak was charged with converting a vial containing a quantity of controlled drugs from Parkway Nursing Home, Inc., St. Petersburg, Florida. Based on the above allegations, the Board of Nursing charged that the Respondent was guilty of violating Florida Statutes, Section 464.21(1)(b), which prohibits illegal and unprofessional conduct.


At the commencement of this hearing the Respondent admitted the above charge and gave a statement on her own behalf. She stated she had collected over a period of time a quantity of pills and had placed them in a plastic vial. She had done so for the purpose of removing these pills from the hospital and giving them to her boyfriend, who at the time she stated "was in the drug selling business." The pills collected were sleeping pills, tranquilizers and barbituates. Ms. Borischek stated that she had placed the pills in a cart and had left them there overnight where they were discovered. The next morning discovery of the pills was announced and all the girls on her floor were questioned regarding the circumstances of these pills having been misappropriated. She later in a letter to the hospital administrator admitted taKing these pills but stated she had not at that time resolved that she would definitely remove these pills from the premises.


Ms. Borischak stated that since this time, she is no longer involved with this boyfriend who instigated her into taking these pills and has since married.


Considering all the circumstances of this matter, particularly in that the Respondent admitted her actions, appeared extremely remorseful about her conduct and had not as of yet demonstrated the specific intention to remove these pills from the hospital. It is recommended her license be suspended for a period of six months.
