RECOMMENDED ORDER


Subsequent to filing the above consolidated permit appeals, the parties entered into a Settlement Agreement. On April 19, 1991, the Department of Community Affairs filed a Motion for Order Approving Settlement Agreement and Relinquishing Jurisdiction to the Florida Land and Water Adjudicatory Commission with a recommendation that the Owner and General Contractor be granted permission to develop according to the terms of the Settlement Agreement. Based upon the foregoing, it is


ORDERED that the Division of Administrative Hearings files in DOAH Case No.

90-3865 and DOAH Case No. 91-1065 (Consolidated) are hereby closed, and


IT IS RECOMMENDED that the Florida Land and Water Adjudicatory Commission enter a Final Order approving the parties' Settlement Agreement, and granting James W. Moore and Four Star Builders permission to develop according to the terms of the Settlement Agreement and other applicable regulatory provisions of the Monroe County land development regulations.
