WILLIAMSON, ("Respondent"), and says: STATE OF FLORIDA | | 1. Petitioner Is the state agency charged with regulating the operation of public lodging establishments and public food service establishments, pursuant to Sec. 20.185 and Chapter 509, Florida Statutes. 2. ‘Respondent is, and has been at all times material hereto, licensed by or subject to i the jurisdiction of the Division of Hotels and Restaurants, The respondent's last ; known business address is 980 NW 9 AVE., POMPANO SCH., FL 33060-5844. : 3. Inspection of this establishment conducted pursuant to Sec. 509.032, Florida i Statutes, revealed violations of the provisions of Chapter 509, Florida Statutes, and / | or the rules promulgated thereto governing operation of the establishment. The violatlon(s) found and applicable law are described in Exhibit “A’*, attached hereto and incorporated herein by reference. WHEREFORE, Petitioner respectfully requests entry of an Order imposing one or more of the following penalties: administrative fine not to exceed $1000 per offense; mandatory attendance at Respondent's expense at an educational program sponsored by the Department's Hospitality Education Program; suspension, revocation, or refusal of a license issued pursuant to this Chapter, and/or any other relief authorized by Chapter 509, Florida Statutes, or the rules promulgated thereto. On each floor level, the area protected and the travel distances shall be based of fire extinguishers installed in accordance with Tables 3-21 and _3-3.4. Portable extinguishers shal! be maintained in a fully charged and operable condition and kept in their designated places at all times when they are not being used. A standard state approved service tag shall be attached to each extinguisher and a person holding a valid state permit’ issued by the State Fire Marshal shall recharge or inspect the extinguisher and shall prepare the tag to include the Information required by tule 4A-21.241, FAC, herein adopted by reference. . OBSERVED FIRE EXTINGUISHER MISSING BY APARTMENT #1 (980) AND ON FIRST FLOOR OF 951. OBSERVED PORTABLE FIRE EXTINGUISHER GAUGE IN RECHARGE BY APARTMENT #8 (970). OBSERVED SERVICE TAG ON PORTABLE FIRE EXTINGUISHER BY APARTMENT #67 (930) TORN AND UNREADABLE. Each public lodging establishment that is three or more stories in height must have safe and secure railings on alt balconies, platforms, and stainways, and all such railings must be properly maintained and repaired. The division may impose administrative sanctions for violations of this subsection pursuant to s. 509.261, OBSERVED BALCONY AND BALCONY RAILING IN DISREPAIR ON BUILDING #980 (part of walkway is broken, several supports are not secured). OBSERVED SEVERAL SUPPORTS FOR BALCONY RAILING NOT PROPERLY SECURED TO SUBSTRATE FOR BUILDING #940, OBSERVED STAIRWELL RAILING HAS SUPPORTS NOT PROPERLY SECURED TO SUBSTRATE FOR BUILDING #940.
