OF LEE COUNTY, INC., d/b/a HOPE HOSPICE & PALLIATIVE ADMINISTRATION, | Respondent. | SETTLEMENT AGREEMENT Petitioner, H.O.P.E OF LEE COUNTY, d/b/a HOPE HOSPICE & PALLIATIVE CARE, and Respondent, AGENCY FOR HEALTH CARE ADMINISTRATION, by and through its undersigned counsel and pursuant to Section 120.57 (4), Fla. Stat. (1999), hereby stipulate and agree as follows: 1. A weighing of all applicable statutory and rules review criteria reveals that Petitioner’s application for Certificate of Need (CON) No. 9244 should be granted. 2. Upon execution and filing of this Settlement Agreement, and receipt of an order from an administrative law judge remanding the case, Respondent shall enter a Final : , Order issuing CON No. 9244 to Petitioner for the construction of a twenty-four (24) bed freestanding inpatient hospice facility in Hospice Service Area 8C. i : : i ra 3. CON No. 9244 shall have the following condition placed upon it: A minimum . of five and nine/tenths percent (5.9%) of total annual patient days of care will be provided to Medicaid patients. 4. The issuance date of CON No. 9244 shall be the date of issuance of the Final vida tig nace 7 ae “ ee ee 5. Each party shall bear its own attorney’s fees and costs. 6. The parties stipulate and agree that this Settlement Agreement is a legal and _ binding document and is fully enforceable in any Court of competent jurisdiction. The signatories hereto represent and warrant that they are vested with the authority to execute this Settlement Agreement on behalf of their respective principals, and as duly designated representatives, to fully bind such principals. 7.
