ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as “Petitioner,” and files this Administrative Complaint before the Board of Pharmacy against JUNE A. GRIFFITH, hereinafter referred to as “Respondent,” and alleges: 1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the ry practice of pharmacy pursuant to Section 20.43, Florida Statutes (Supp. 1996); Chapter 455, Florida Statutes; and Chapter 465, Florida Statutes. Pursuant to the authority of Section 20.43 (3)(g), Florida Statutes, the Petitioner has contracted with the Agency of Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. 2. Respondent is, and has been at all times material hereto, a licensed pharmacist in the State of Florida, having been issued license number 0027152. Respondent’s last known address is 895 Little Bend Road, Altamonte Springs, Florida 32714. ’ 3. On or about March 7, 1998, Respondent mistakenly filled a patient’s prescription for Toprol XL 100mg with Toprol XL 50mg. YY Nw] 4. The patient ingested 6-7 of the incorrect dosage, felt weak, had chest pains, and. did not feel well overall. Her doctor indicated the symptoms were the side effects of “sudden withdrawal from a Beta blocker.” 5. Once the patient’s prescription was corrected she felt better within a few days and her symptoms dissipated. 6. Respondent stated that she had made a mistake. She had been the only pharmacist working on March 7, 1998 and she had worked a 16 hour day. 7. The pills were analyzed by the manufacturer and determined to be normal regarding chemical stability. COUNT I 8. Petitioner realleges and reincorporates the foregoing factual allegations as if fully stated herein. , 9. Based on the foregoing, Respondent is subject to discipline for violating Section 465.016(1)(e), Florida Statutes, by violating 465.016(1)(g), Florida Statutes by using in the compounding of a prescription, or furnishing upon prescription, an ingredient or article different in any manner from the ingredient prescribed. WHEREFORE, Petitioner respectfully requests the Board of Pharmacy enter an order imposing one or more of the following penalties: revocation or suspension of the Respondent’s license, restriction of the Respondent’s practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, and/or any other relief that the Board deems appropriate.
