SS ADMINISTRATIVE COMPLAINT _ COMES NOW, the Petitioner, Department of Health, and files this Administrative Complaint before the Board of Pharmacy, against the Respondent, COREY O. COLLINS, and in support thereof would state: 1. Petitioner is the state agency charged with regulating the practice of pharmacy, pursuant to Section 20.43, Florida Statutes, Chapter 455, Florida Statutes, and Chapter 465, Florida Statutes. 2. Pursuant to the authority of Section 20.43(3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration, hereinafter referred to as the "Agency," to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. | 3. Respondent has been at all times pertinent hereto, a duly licensed pharmacist pursuant to Chapter 465, Florida Statutes, having been issued license number Can | U PS 0030751. Respondent’s last known address is 4002 Lasalle Street, Tampa, Florida "33607. 4. At all times material hereto, the Respondent was employed as a relief pharmacist at the Eckerd’s Pharmacy located at 2646 Crawforville Highway, Crawforville, Florida. 5. In or around May 1998, the Eckerd’s Pharmacy located at 2646 Crawforville Highway, Crawforville, Florida received a prescription for patient A-L. for 500 mg. of Chloral Hydrate 500/5. _6,___In or around May 1998, the Respondent dispensed 500 milliliters of Chlorah Hydrate 500/5 to patient A.L. instead of the prescribed 500 mg of Chloral Hydrate 500/5. 7. Based on the foregoing, the Respondent’s license to practice pharmacy in the State of Florida is subject to discipline for violating Section 465.016(1)(g), Florida Statutes. 6. The conduct of the Respondent as aforesaid is contrary to the provisions contained in Section 465.016(1), Florida Statutes, and Rule 64B16-26.103, Florida Administrative Code, which requires a pharmacist to satisfactorily prove that during the. two years-prior their application for renewal of a license, that they have participated in not less than fifteen (15) hours per year of continuing professional pharmaceutical education in courses approved by the Board, including, but not limited to the course in HIV/AIDS. YU ww) WHEREFORE, Petitioner respectfully requests the Board of Pharmacy enter an " Order imposing one or more of the penalties proscribed by law, together with any other and further relief deemed just under the circumstances.
