MCINTYRE, Respondent. ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF HEALTH, hereinafter referred to as “Petitioner,” files this Administrative Complaint before the Board of Speech-Language Pathology and Audiology against PATRICIA M. MCINTYRE, hereinafter referred to as “Respondent,” and alleges: 1, Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of Speech-Language Pathology and Audiology pursuant to Section 20.43, Florida Statutes, Chapter 455, Florida Statutes; and Chapter 468, Florida Statutes. Pursuant to the authority of Section 20.43 (3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. — — 2. Respondent is, and has been at all times material hereto, a licensed Speech Language Pathologist and Audiologist in the State of Florida, having been issued license number SA 0001984, 3. Respondent’s last known address is 156 Garfield Street, Santa Rosa Beach, Florida, 32459. 4, On or about May 15, 1998, Respondent sent her assistant to a meeting alone where an Individual Education Plan (IEP) was discussed. 5. | Onor about May 15, 1998, this assistant was planning a treatment based upon assessment or diagnostic. 6. On or about May 15, 1998, this assistant signed a document without the Respondent being there tolco-sign as her supervisor. 7. The above-mentined tasks were delegated by Respondent to her assistant who was not trained, experienced or had the authorization to perform them. 8. Based on the foregoing, the Respondent has violated Section 468.1295(1)(z), Florida Statutes, by delegating professional responsibilities to a person the licensee knows, or has reason to know, such person is not qualified by training, experience and authorization to perform the responsibilities given.
