ADMINISTRATIVE COMPLAINT
COMES NoW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner",
d files this Administrative Complaint before the Board of Dentistry against, LAMONT
CANADA D.D. S. hereinafter referred to as “Respondent”, and alleges:
1. petitioner qs the state agency charged with regulating the practice of dentistry
pursuant to Section 20.43, Florida Statutes; Chapter 458, Florida Statutes; and Chapter 466, Florida
Statutes. Pursuant to the authority of Section 20. 43 (3) (2) Florida Statutes, the Petitioner has
contracted with the Agency for Health Care Administration to provide consumer complaint,
investigative, and prosecutorial services required by the Division of Medical Quality Assurance,
councils, or ‘poards, as approptiate.

In or around May 1998, B.S. presented her son RS. to the Respondent for dental
treatment consisting of extraction of the lower right deciduous 2nd molar or (#t) as prescribed by
The Respondent extracted the lower left deciduous 2nd molar or (#k) instead of
his orthodontist.

Tooth (#t) had-a permanent successor trying to erupt and removal was necessary to
allow that successor to erupt. ‘

Tooth (#k) had no permanent successor thereby increasing its’ importance.
R.S.’s referring orthodontist clearly marked the removal of (#t).
Neither B.S. nor the prescribing orthodontist ordered the removal of tooth (#k).
The Respondent wrongfully extracted tooth (#k) ot (#20).
Based on the foregoing, the Respondent’s license to practice dentistry in the State of
Florida is subject to discipline pursuant to Section 466.028 (1)(x), Florida Statutes, for being guilty
of incompetence or negligence by failing to meet the minimum standards of performance in
diagnosis and treatment when measured against generally prevailing peer performance, including,
but not limited to the undertaking of diagnosis and treatment for which the dentist is not qualified
by training or experience or being guilty of malpractice.

imposing one or more of the following penalties: revocation or suspension of the Respondent's
