ADMINISTRATIVE COMPLAINT

COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner",
and files this Administrative Complaint before the Board of Dentistry against David H. Hock,
DDS. P.A., hereinafter referred to as “Respondent”, and alleges:
1. Petitioner is the state agency charged with regulating the practice of dentistry
pursuant to Section 20.43, “Florida Statutes; Chapter 455, Florida Statutes; and Chapter 466, Florida
Statutes. Pursuant to the authority of Section 20.43 (3) (g), Florida Statutes, the Petitioner has
contracted with the Agency for Health Care Administration to provide consumer complaint,
investigative, and prosecutorial services required by the Division of Medical Quality Assurance,
‘councils, or boards, as appropriate.

State of Florida, having been issued license number DN 0007515. Respondent's last known
| address is 5 4040 ‘Newberry Road, #1200, ‘Gainesville, Florida 32607-2357. .
3. On or around September 3, 1998, Patient LR., presented to Respondent for repair of
tooth #29. -
4, Patient L.R.’s tooth #99 helped support a partial denture.

5. The Respondent placed a crown on Patient’s tooth #29.
6. Subsequently, Patient L.R’s. partial denture did not fit properly causing her bite to
be off.
7. ‘The Respondent was unable to correct the problem.
—8. The Patient’s records consisted of an outline of treatment and one x-ray.
9. Rule 64B5-17.002(1), Florida Administrative Code, states that for the purpose of
implementing the provisions of Section 466.028(1)(m), Florida Statutes, a dentist shall maintain
written dental records on each patient which written records shall contain, at a minimum, the
following information about the patient:
| (a) appropriate medical history;
(b) results of clinical examination and tests conducted, including the identification, or
lack thereof, of any oral pathology or diseases;
- © treatment plan proposed by the dentist; and
@ treatment rendered to the patient.
10. ~The Respondent failed to maintain the minimum record requirements mandated by
Rule 64B5-17.002 (1), Florida Administrative Code, because his secords of Patient E.S. consisted
only, of an outline of treatment and one x-ray.
11. Based on the foregoing, the Respondent’s license to practice dentistry in the State of
. 2 Florida i is subject to discipline pursuant to Section 466.028 (1)(m), Florida Statutes, for failing to
keep written dental records and medical history records justifying the course of treatment of the
patient including, but not limited to, patient histories, examination results, test results, and X rays, if
taken. -

WHEREFORE, Petitioner respectfully requests the Board of Dentistry enter an order
imposing one or more of the following penalties: revocation or suspension of the
Respondent's license, restriction of the Respondent's practice, imposition of an
administrative fine, issuance of a reprimand, placement of the Respondent on probation,
~ “and/or any other relief that the Board deems appropriate. ;
