By a decision letter dated January 20, 2000, the agency notified the Respondent of the agency’s intent to deny the Respondent’ s application for a license to operate as an assisted living facility. See administrative complaint marked as Exhibit A and decision letter marked as Exhibit A-1; both are incorporated herein by reference. The Respondent filed requests for an actions. See Respondent’s requests marked as Exhibit B and B-1 incorporated herein by reference. 3. On June 9, 2000, the parties. executed a settlement including the following terms: (a) the 3S not to operate as an ALF it is licensed, - (b) the Respondent agrees to conduct its business affairs i Be i i promulgated thereunder, and (c) the Respondent, agrees to payment of the proposed fine of $1,500.00. See settlement marked as Exhibit c incorporated herein by reference. Payment in full has been received by the agency. 4. On May 23, 2000, the administrative law judge closed the Division’s file and relinquished jurisdiction to the agency. See order closing file marked as Exhibit D and incorporated herein by reference.
