ADMINISTRATIVE COMPLAINT
Petitioner, DEPARTMENT OF HEALTH, hereinafter referred to as
“Petitioner,” files this Administrative Complaint before the Board of
Clinical Social Work, Marriage and Family Therapy, and Mental Health
Counseling against IRENE MARIE GREENE, hereinafter referred
toas “Respondent,” and alleges: |
1. Effective July 1, 1997, Petitioner is the state agency charged
with regulating the practice of Clinical Social Work pursuant to Section
20.43, Florida Statutes, Chapter 455, Florida Statutes; and Chapter 491,
Florida Statutes. Pursuant to the authority of Section 20.43 (3)(g), Florida
Statutes, the Petitioner has contracted with the Agency for Health Care
Administration to provide consumer complaint, investigative, and
prosecutorial services required by the Division of Medical Quality

Assurance, councils, or boards, as appropriate, including the issuance of
emergency orders of suspension or restriction.
2. Respondent is, and has been at all times material hereto, a
licensed Clinical Social Worker in the State of Florida, having been issued
license number SW 0002698.
3. Respondent’s last known address is Rural Route 1, Box 510,
Belgrade, Maine, 04917.
4. On or between September 4, 1994 through April 1, 1995 and
January 2, 1996, through April 1, 1996, patient B.C. received therapy and
treatment from the Respondent.
5. In or about early 1998, the Respondent moved from Plantation,
Florida to Belgrade, Maine.
6. On at least two (2) occasions, February 8, 1998 and March
19, 1998, Patient B.C. attempted to obtain a copy of her records from the
Respondent.
7. Patient B.C. received no response from the Respondent to her
aforementioned requests for records.
8. Rule 64B4-9.001(3), Florida Administrative Code, states the
following:
When a clinical social worker,.....terminates practice or
relocates and is no longer available to clients or users, the
clients or users shall be notified of such termination or

relocation and unavailability by the licensee's causing to
be published in the newspaper of greatest general
circulation in the county in which the licensee practices
Or practiced, a notice which shall contain the date of
termination or relocation and an address available to the
client, user, or to a licensed mental health professional
designated by the client or user. The records shall be
retained for two (2) years after the termination or
relocation of the practice.
9. When the Respondent moved to Belgrade, Maine, she did
not provide the notification required by Rule 64B4-9.001 (3), Florida’
Administrative Code.
COUNT I -
10. Petitioner alleges and incorporates by reference the allegations
contained in paragraphs one (1) through nine (9) as if fully stated herein.
11. Based on the foregoing, the Respondent is subject to discipline
pursuant to Section 491.009 (2)(q), Florida Statutes, for violating Rule
64B4-9.001(3), Florida Administrative Code, by failing to provide
notification of her relocation. : ~ oo
WHEREFORE, Petitioner respectfully requests the Board of Clinical
Social Work, Marriage and Family Therapy, and Mental Health Counseling
to enter an order imposing one or more of the following penalties:
revocation or suspension of Respondent’s license, restriction of
Respondent’s practice, imposition of an administrative fine, issuance ofa

reprimand, placement of Respondent’s license on probation for a period of
time and subject to terms and/or conditions, and/or any relief which the
Board deems appropriate.
