Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of pharmacy pursuant to Section 20.43, Florida Statutes (Supp. 1996); Chapter 455, Florida Statutes; and Chapter 465, Florida Statutes. 2.. Pursuant to the authority of Section 20.43 (3)(g), Florida Statutes (Supp. 1996), Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality _ Assurance, councils, or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. 3. Respondent is, and has been at all times material hereto, a licensed pharmacist, having been issued license number PS 0027443. vy. =e 4. Respondent’s last known address is 3136 Atwater Drive, Orlando, FL 32825. 5. At all times material hereto Respondent is employed by Eckerd Drug Store 10952 E. Colonial Drive, Orlando, FL 32826. . 6. On or about August 5, 1997, Respondent received and filled a prescription for Lortab Elixir for use by Patient S.J. 7. On or about August 5, 1997, the said prescription dosage as prescribed by Patient §.J.’s Doctor was for 2cc. 8. On or about August 5, 1997, Respondent filled above said prescription and labeled dosage instructions as 2 teaspoonfuls. 9. Ina letter dated on or about November 17, 1997, in response to the allegations, Respondent stated a typographical error occurred and the Lortab Elixir prescription was wrongly transcribed to two (2) teaspoonfuls. COUNT I 10. Petitioner realleges and incorporates by reference the allegations contained in the forgoing paragraphs as if fully stated herein. 11. Based on the forgoing, the Respondent’s license to practice pharmacy in the State of Florida is subject to discipline pursuant to Section 465.016(1)(g), Florida Statutes, for furnishing upon prescription, an ingredient or article different in any manner from the ingredient | or article prescribed. . COUNT IE 12. Petitioner realleges and incorporates by reference the allegations contained in | paragraphs one (1) through nine (9) as if fully stated herein. *® 13. Based on the forgoing, the Respondent’s license to practice pharmacy in the State of Florida is subj ect to discipline pursuant to Section 465.016(1)(n), Florida Statutes, by violating Rule 64B16-27.400(1)(g), Florida Administrative Code, by failing to certify the finished prescription. WHEREFORE, Petitioner respectfully requests the Board of Pharmacy enter an Order imposing one or more of the following penalties: imposition of an administrative fine not to exceed $1,000 for each offense, issuance of a reprimand, placement of the Respondent on probation, and/or any other relief that the Board deems appropriate.
