CASE NUMBER: 1998-01217 RESPONDENT. / ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner", and files this Administrative Complaint before the Board of Dentistry 1. against ILIANA M. CABEZA, D.D.S., hereinafter referred to as "Respondent", and alleges: Petitioner is the state agency charged with regulating the practice of dentistry pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 466, Florida Statutes. Pursuant to the authority of Section 20.43 (3) (g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. 2. Respondent is, and at all times relative hereto has been, a licensed dentist in the State of Florida, having been issued license number DN 0009561. Respondent is 12825 SW 6" Street, Miami, Florida 33184. 's last known address 3. On or about January 22, 1998, the Respondent was indicted by the USDEA (United States Drug Enforcement Agency) for possessing cocaine with intefit to distribute. a a -f c HG ‘wo a ao) 4. On or about January 22, 1998, the Respondent entered a plea of guilty and was adjudicated guilty of one count of a third degree felony charge of conspiracy to possession with intent to distribute cocaine, in case number 1:97-CR00919-002, filed in the Court, Southern District of Florida. 5. On or about July 22, 1999, the Respondent was sentenced United States Bureau of Prisons to be imprisoned for fifty-one (51) months September 7, 1999. United States District to the custody of the beginning on or about 6. Cocaine is a Schedule II controlled substance under Chapter 893, Florida Statutes. A substance in Schedule II has a high potential for abuse and has a currently accepted but severely restricted medical use in treatment in the United States, and abuse of the severe psychological or physical dependence. 7. The Respondent’s charge of conspiracy to possession with the intent to distribute is acrime, which relates the practice of dentistry. 8.
