ADMINISTRATIVE COMPLAINT
COMES NOW, the Petitioner, Department of Health, hereinafter referred to as
“Petitioner,” and files this Administrative Complaint before the Board of Pharmacy
against MEDIPLEX REHAB-BRADENTON, hereinafter referred to as “Respondent,”
and alleges:
1. Effective July 1, 1997, Petitioner is the state agency charged with
regulating the practice of pharmacy pursuant to Section 20.43, Florida Statutes ; Chapter
455, Florid Statutes; and Chapter 464, Florida Statutes. Pursuant to the authority of
the Petitioner has contracted with the Agency of
Health Care Administration to provide consumer complaint, investigative, and
prosecutorial services required by the Division of Medical Quality Assurance, councils, .

2. Respondent is, and has been at all times material hereto, a licensed
Pharmacy in the state of Florida, having been issued license number PH 0013051.

3. On or about November 5, 5; 1997, a ‘Toutine inspection of Respondent
facility revealed that the nursing staff routinely borrowed medications from patients and
administered them to other patients.
4. The consultant pharmacist of Respondent facility has indicated that she
was not an active participant in this practice. She further states that she provided written
notice to the Director of Nursing regarding the necessity to cease the practice.
5. Based on the foregoing, Respondent i is subject to discipline pursuant to
Section 465. 023(1Y(), F lorida Statutes by violating Section 465. 019(5), Florida Statutes,
for failing to the pharmacy under the professional supervision of a consultant pharmacist,
and having the compounding and dispensing of medicinal drugs done only by a licensed
