mo STATE OF FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES Department of Children and Families Petitioner vs. Lisa Cillo Owner of Miss Lisa’s Family Day Care Home ye ADMINISTRATIVE COMPLAINT 1. This is an Administrative Complaint by the Department of Children and Families against Lisa Cillo, owner/operator of Miss Lisa’s Family Day Care Home for the imposition of an Administrative fine of $400.00. : 2. Miss Lisa’s Family Day Caré Home is a Family Day Care Home that was licensed by the - Department of Children and Families with license number 130499, to the present owner on July 19, 1996, for operation at 30 Wenona Avenue, Ocala, FL 34471. _ 3, The Department of Children and Families imposes on the respondent facility one or more administrative fines, in the total amount of $400.00. This fine is imposed for the violation of F.S. 402.301 et.seq. and Florida Administrative Code, Chapter 65C-20., more particularly set forth in paragraphs 4(a) through 4(e) of this complaint. ‘4. (a) Violation(s): The facility is in violation of the FAC 65C-20 and F.S. 402.301-402.319 by reasons of the following facts: . . Violations): - mount: i. F.S. 402.302(7)(a)(b) Noncompliance of _ $100.00 -- Staff/Child Ratios ~ 65C-20.009(3)(a) : : Direct supervision - ~~ $100.00 65C-20.010(3)(b)(4) Incomplete emergency $50.00 coe ee ‘procedures 65C-20.009(1)(b) Noncompliance of written $50.00 Substitute plan 65C-20.012(3) Access to premises $100.00 A description of the fackeete as follows: i) Respondent committed a violation of F.S. 402.302 (7)(a)(b) in that, on August 24, 1999, at ".. approximately 1:30 pm, the licensing counselor found a substitute caring for seven children (five infants and two preschoolers). The licensing counselor attempted to conduct a follow up ~ inspection on September 2, 1999 at approximately 12:15 pm and found Ms. Cillo caring for six _ children (4 infants and two preschoolers). Respondent committed a violation of 65C-20.009(3)(a) in that, on August 24, 1999 five of the children present during this inspection were found sleeping in two different bedrooms upstairs with the doors to the rooms closed. Baby monitors in the rooms do not take the place of direct supervision. On a follow up _. inspection on September 2, 1999 at approximately 12:15 pm, Ms. Cillo left five onthe six ” children in care unsupervised in the downstairs playroom while she went upstairs . All of these children are under two years of age. Several of the infants were left sitting or laying on beanbags, while others were left crawling around on the floor. Respondent committed a violation of 65C-20.010(3)(b)(4) in that, during the inspection on August 24, 1999, Ms. Cillo stated that she had not been conducting and recording monthly fire drills. She stated, “I’ve never had to do them before.” Counselor asked Ms. Cillo to conduct and record at least one fire drill before the counselor came back to conduct a follow up inspection the following week. On September 2, 1999, during the follow up inspection, Ms. Cillo stated that she had done a-fire drill, but refused to show the documentation to the licensing counselor. Respondent committed a violation of 65C-20.009(1)(b) in that, on August 24, 1999 and September 2, 1999 Ms. Cillo did not have a written plan for her substitute. She stated that she had the written plan completed, but refused to show the documentation to the licensing counselor. Respondent committed a violation of 65C-20.012(3) in that on September 2, 1999, Ms. Cillo became angry, argumentative and uncooperative with the licensing counselor. Ms. Cillo refused to allow the licensing counselor to complete the follow up inspection. She was verbally abusive to licensing counselor. The licensing counselor was told by Ms. Cillo “I’m not answering any more questions and you can leave my house at any time now.” ; (b) If you do not request a hearing, the fine of $400.00 will become final thirty (30) days after receipt of this complaint. (c) Your request for an Administrative Hearing, if desired, must be RECEIVED by Children and Families within thirty (30) days of your receipt of this COMPLAINT, and must comply with the ‘requirements for Rules 10-2. 36 and’28.5.201, Florida Administrative Code.
