ANDERSON, RESPONDENT. — / ADMINISTRATIVECOMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner", _and files this Administrative Complaint before the Board of Dentistry against LAWRENCE L. ANDERSON, hereinafter referred to as ss "Respondent" ar and alleges: 1. Effective July 1 1, 1997, Petitioner i is the state agency charged with regulating the practice of dentistry pursuant to Section? 220. 43, Florida Statutes (Supp. 1996); Chapter 455, Florida Statutes; and Chapter 466, Florida Statutes. Pursuant to o the authority of Section 20.43 (3) (D, Florida Statutes, the Petitioner has contracted with the Agency fi for Health Care Administration to provide consumer er complaint, investiga ive, >and Pp cutorial services required by the Division of pofindci nial ohana anit aaa thst eae gna wintering aegis Medical Quality Assurance, councils, or boards, as appropriate. : Respondent is, and has been at ‘ail’ times material hereto, a licensed dentist in the ; ‘State of Flo id , having been fsoued license umber DN 0013028. Respondents I last known ‘addressi is 3300 Bonita Beach Road #11, Bonita Springs, ‘Florida 33923. 3, On or about June 25, 1996, Patient Ws. presented to the Respondent to have eight . (8) dental veneers attached to the four front upper teeth and four front lower teeth. } U 4. On or about February 4, 1997, Patient WI. experienced bleeding in his mouth two to three times a week . iS 5. Patient W.J.’s gums began to swell and made the gum tissue very tender. Patient W.J. could no longer brush his teeth without experiencing severe pain. 6. Patient W.J. informed the Respondent that the veneers were too long and were ~ protruding into his upper gum tissue. The Respondent disagreed, but did grind down the veneers to make them smaller. 7. The Respondent improperly installed dental veneers on Patient W.J., which has caused continued gum bleeding. 8. Based on the foregoing, the Respondent’s license to practice dentistry in the State of Florida is subject to discipline pursuant to Section 466.028 (1)(x), Florida Statutes, for being guilty of incompetence or negligence by failing to meet the minimum standards of performance in diagnosis and treatment when measured against generally prevailing peer performance, including, but not limited to, the undertaking of diagnosis and treatment for which a dentist is not qualified by training or experience or being guilty of dental malpractice. pet ee eee ems el aL al WHEREFORE, Petitioner respectfully requests the Board of.
