MINISTRATI MPL COMES NOW the Florida Engineers Management Corporation, hereinafter referred to as “Petitioner,” and files this Administrative Complaint before the Board of Professional Engineers against Robert J. Hudek, P.E., hereinafter referred to as “Respondent”. This Administrative Complaint is issued pursuant to Sections 120.60 and 471.038, Florida Statutes, Any proceeding concerning this complaint shall be conducted pursuant to Section 120.57, Florida Statutes. In support of this complaint, Petitioner alleges the following: eee 1. Petitioner is charged ¥ with th providing administrative, investigative, and prosecutorial services sto ‘the Boaré Profess ional Engineers pursuant to Section 47. 1 038(4), Florida Statutes (1997), The Board of P Professional Engineers: is charged with regulating t the practice of engineering pursuant to Chapter 455, Florida Statutes and Chapter a”, Florida Statutes Ww . U 2. Respondent is and has been at all time material hereto a licensed professional engineer in the State of Florida, having been issued license number PE 14207. Respondent’s address of record is 15290 Palmetto Lake Drive, Perrine, Florida 33157-1748. 3. On or “about October 13, 1998, a ‘twelve-year old child was fatally electrocuted at ‘the bus shelter 1 near r the i intersection of Southwest ‘oat Street and 108" Court. 4. In or about April 1998 Respondent was employed by the Metro-Dade Transit Agency as an electrical inspector. 5. In the course of his duties, Respondent inspected the electrical work at the bus shelter at the corner of Southwest 24" Street and 108" Court. 6. By letter dated April 13, 1998, Respondent stated that he had inspected and approved several bus shelters, including the shelter at Southwest 24" Street and 109" Avenue, and requested that Florida Power and Light proceed with providing electrical services at that location. 7. There is no bus shelter at Southwest 24" Street and 109" Avenue. The closest shelter is the one on Southwest 24" Street and 108" Court. 8. Respondent’s inspection was deficient in that he failed to note that the a transformer was not properly mounted. 9. Respondent also failed to note that fuses were inappropriately placed and 10. Based on the foregoing, Respondent is charged with violating Section 471.033(1)(g), Florida Statutes, by engaging in negligence in the practice of engineering. Ww ; ww) WHEREFORE, the Petitioner respectfully requests the Board of Professional Engineers to enter an order imposing one or more of the following penalties: permanent revocation or suspension of the Respondents license, restriction of the Respondent’s practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, the assessment of costs related to the investigation and prosecution of this case, other than costs associated with an attorney’s time, as provided for in Section 455.227(3), Florida Statutes, and/or any other relief that the Board deems appropriate. t- SIGNED this a0 day of , 2000.
