ADMINIS TRATIVE COMPLAINT
COMES NOW the Florida Engineers Management Corporation, hereinafter
referred to as “Petitioner,” and files this ‘Administrative Complaint before the Board of
Professional Engineers against Gary P. Grunau, P.E., hereinafter referred to as
“Respondent”. This Administrative Complaint is issued pursuant to Sections 120.60 and
471.038, Florida Statutes. Any proceeding concerning this complaint shall be conducted
pursuant to Section 120.57, Florida Statutes. In support of this complaint, Petitioner
alleges the following:

with regulating the practice of engineering Pursuant to Chapter 4 455, » Florida Statutes and

2. __Respondent is and has been at all time material hereto a licensed
professional engineer in the State of Florida, having been issued license number PE
34737. Respondent’s address of record is P. O. Box 479, Milwaukee, WI 53201-0479,
3. Respondent is the Chief Executive Officer of Granau Company, Inc., a
fire protection system company located in Orlando, Florida.
4. Petitioner realleges and incorporates paragraphs one through three as if
fully restated herein this Count One.
5, The Grunau Company offers aneannea services in the State of Florida.
6. . Section 471.023(1), Florida Statutes, states the practice of, or the offer to
practice, engineering by registrants through a corporation offering engineering services to
the public is permitted only if the firm possesses a certification issued by the department!
7. ‘The Grunau Company does not hold a Certificate of Authorization to offer
éfigineering services in Florida. . . |
8. Based on the foregoing, Respondent is charged with violating Section
471.033(1)(a), violating a provision of Chapter 471, through a violation of Section
471.023(1), Florida Statutes, by offering engineering services through a corporation
which has not been issued a Certificate of Authorization. _

(FEMC) was created to provide administrative, investigative, and prosecutorial services to the Board of
Professional Engineers.

10. On or about December 8, 1999, Subject signed and sealed a fire protection
plan on a project referred to as Kash-N-Karry #1846 in Oviedo, Florida. This plan was
submitted to the City of Oviedo for permitting.
11. Subject’s fire protection plan and calculations contain numerous
deficiencies including but not limited to the following:
a. The spray application density is not in compliance with NFPA 13 5-
2. 3. 1. 3@), 1996;
a >. - The inside diameter of 4.8 inches shown for the 4” ductile iron feeder pipe
- is incorrect;
c. ‘The plans do not indicate what class of ductile iron pipe is to be used; .
d. The friction pressure loss for pipe 43 is incorrect.
12. Based on the foregoing, Respondent is charged with violating Section
471.033(1)(g), Florida Statutes, engaging in negligence, incompetence, or misconduct, in
the practice of engineering.
WHEREFORE, the Petitioner respectfully requests the Board of Professional
Engineers to enter an order i imposing one or more of the ° following penalties: permanent
Tevocation or suspension of the Respondent s license, restriction of the Respondent’s
- practice, imposition of an n administrative fine, issuance of a Teprimand, placement of the
