OOMAY 31 PHI2= 38 : avase DEPARTMENT OF HEALTH, f HST PETITIONER, HEARHIGS vs. CASE NUMBER: 99-62204 ANGELIKA KESSLER- STRACHAN, RESPONDENT. - — 90-2S 20 ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner", and files this administrative complainant before the Board of Nursing Home Administrators against ANGELIKA KESSLER-STRACHAN, hereinafter referred to as "Respondent", and alleges: 1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of Nursing Home Administration pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 468, Florida Statutes. Pursuant to the authority of Section | 20.43(3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards as appropriate including the ~ issu f tgency orders of suspension or restriction. - ‘Administrator in the State of Florida, having been issued license number NHA 3137.” “! 3, Respondent's last known address is 4398 Stilling Circle, Destin, Florida 32541-3454. plants 6. ~ Respondent did: not reimburse the company for her purchases. EXHIBIT A "Respondent is, and. has ‘been at ali time material hereto, ‘a licensed Nursing Home 5. Respondent charged to the company account personal items such as appliances and ewe ere with the health, safety and welfare of its patients. vy. | wi 7. Therefore, the Respondent was terminated from Sunbridge Health Care facility. 8. After the Respondent gathered her belongings, Schedule TI medications from residents at the facility were found in the Respondent's desk on or about November 17. 1999. 9. The Schedule I medications that were removed from her desk dated back to February. 1999. 10. Some of the medications contained the names of prior deceased and current residents and some eof the medications were not labeled for anyone. 11. The controlled medications should have been logged in and destroyed, which they wére not. a Lo . 12. Therefore Respondent has violated Sections 468.1755(1)(h)(1), Florida Statutes. for _. misconduct in the Practice of nursing home administration and by acting in a manner inconsistent WHEREFORE, Petitioner respectfully requests that the Board of Nursing Home - Administration enter an order imposing one or more of the following penalties: revocation or . suspension of the Respondent's license, restriction of the Respondent's practice, imposition of an administrative fine, issuance of a 2 reprimand, placement of the Respondent on probation and/or any other relief that the Board deems appropriate.
