ZL 4 3Y / ADMINIS RATIVE COMPLAINT COMES NOW, the Petitioner, Pinellas County Construction Licensing Board, hereinafter referred to as "Petitioner,” and files this Administrative Complaint against DAVID G. BEERS, hereinafter | referred to as "Respondent," and alleges: 1. Petitioner seeks to suspend, revoke or take other disciplinary action against the Respondent as licensee and against his license to practice contracting pursuant to Chapter 89-504, Laws of Florida, as amended. 2. Respondent is a certified painting specialty contractor having been issued license C-8185 and a certified residential contractor C-8184 not known to be registered with the Construction Industry Licensing Board. Respondent's, last known address is 200 Coffee Pot Rivera, N.E., St. Petersburg, FL 33704. 3. At all times material Respondent was the qualifying contractor for David G. Beers. , COUNT ONE 4. On or about December 4, 1999, Respondent contracted with owner (Lakhotia) to install new windows at 10196 Imperial Point Drive E. For $6,270 and was paid a $2,070 deposit. 5. At the time of the contract Respondent had not registered his PCCLB-issued competency card as a residential contractor with the Florida Construction Industry Licensing Board and thus violated Section 489.113 (1), Florida Statutes. ee J ‘ COUNT TWO 6. Paragraphs 4 - 5 are restated 5 if in full. 7. Respondent abandoned the job and did nol retum the $2,070 deposit within 30 days as required by Section 24 (2)(h)(2), Chapter 89-504, Laws of Florida, as amended. COUNT THREE 8. Paragraphs 4 - 7 are restated as if in full. 9. Respondent accepted a down payment of more than ten percent of the contract price, did not obtain the permit within 30 days, and did net start the work within 90 days, in violation of Section 489.126 (2), Florida Statutes. Based on the foregoing, Respondent violated Section 24 (2)(d)(h)(j)(m)(n), Chapter 89-504, Laws of Florida, as amended. SIGNED this 12th day of May, 2000. William J.
