DIVISION II DEPARTMENT OF BUSINESS AND Od-2ub- PROFESSIONAL REGULATION, : Petitioner, Case No. 98-23295 vs. GERALD TEALLOW, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against GERALD TEALLOW, ("Respondent"), and says: 4. petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida statutes, and Chapters 455 and 489, Florida Statutes. 2. Respondent is, and has been at all times material hereto, a Certified Roofing Contractor, in the State of Florida, having been issued license number cc c056924. 3. Respondent's last known address is 1213 pope Lane, Lake Worth, Florida 33460. cen 4. At all times material hereto, Respondent was the licensed qualifier for General Services of Florida Roofing Co. (hereinafter referred to as "Contractor") and was responsible in such capacity for all of its contracting activities. COUNT I 5. Petitioner realleges and incorporates the allegations set forth in paragraphs one through four as though fully set forth in this Count I. ; 6. On or about July 3, 1998, the Contracted contracted with David O’Connel (hereinafter referred to as “Customer”) to reroof the flat deck of the Customer’s house at 59 SW 9 Avenue, Boca Raton, Florida, for One Thousand, Four Hundred Eighty Five dollars ($1,485.00). 7. ‘The customer paid the Contractor ‘the full contract price for the project. . . 8. The contract contained a five year labor warranty and a ten year materials warranty. 9. In or around September 1998, the Customer’s roof began to leak. . ~ seis .10. The Contractor has failed to correct the leak in the Customer’s roof. 11. The Contractor has failed to honor the warranty provided to the Customer. pe eee eget pene os npn ee ee EERE REE ee Meer re et ww YW 12. Failing to honor a warranty constitutes misconduct in the practice of contracting. 13. Based on the foregoing, the Respondent violated Section 489.129(1) (n), Plorida Statutes (1997), by committing incompetency or misconduct in the practice of contracting. COUNT II 14, Petitioner realleges and incorporates the allegations set forth in paragraphs one through four and six through twelve as though fully set forth in this Count II. 15. The Contractor failed to obtain the required permit from the local Building Department for the Customer's roof ‘project. a . 16. Based on the foregoing, the Respondent violated Section 489.129(1) (p), Plorida Statutes (1997), by proceeding on any job without obtaining applicable local building department permits and inspections. WHEREFORE Petitioner respectfully requests the Construction Industry Licensing ‘Board enter, an “Order imposing one oll wing penalties: “place on probation, “OL more of the reprimand the licensee, revoke, “Suspend, deny t the issuance or renewal of the certificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, ae eg impose any or all penalties’ delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder.
