Z, “Ose, SD vs. Case No. 98-11417 o DOUGLAS STEPHEN LIVINGSTON a/k/a O- % 0 i 4 DOUG LIVINGSTON b Respondent . / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against DOUGLAS STEPHEN LIVINGSTON a/k/a DOUG LIVINGSTON, ("Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes, and the rules promulgated thereto. 2. At all times material hereto, Respondent was not duly licensed as a Contractor by the Florida Electrical Contractor’s Licensing Board or the Construction Industry Licensing Board. 3. The Department of Business and Professional Regulation has jurisdiction over the unlicensed practice of contracting Ww YW pursuant to Section 455.228(1), Florida Statutes, including the authority to impose a fine of up to $5,000.00 per incident for any violation of Chapter 489, Florida Statutes. 4. Respondent's last known address is 5750 NE 27% Avenue, Ft. Lauderdale, Florida 33308. 5. On or about December 31, 1997, Respondent submitted a proposal to ALWIN INTERNATIONAL, INC. (hereinafter “ ALWIN” ) to perform demolition, construction, plumbing and electrical work of the type requiring certification or registration under Chapter 489, Florida Statutes. 6. The proposed project was located at 2141 Blount Road, Pompano Beach, Florida, and the proposed price was $26,000.00. 7. Based on the foregoing, the Respondent violated Chapter 489.531(1) (a) Florida Statutes, (1997), by engaging in the business or acting in the capacity of an electrical contractor without being duly registered or certified or having a certificate of authority. 8. Based on the foregoing, Respondent violated Chapter 489.127 (f), Florida Statutes (1997), by engaging in the business or acting in the capacity of a contractor or by advertising himself or a business organization as available to engage in the business or act in the capacity of a contractor without being duly registered or certified. U UY WHEREFORE, Petitioner respectfully requests the entry of an Order imposing one or more of the following penalties: impose an administrative fine not to exceed $5,000.00 per violation, impose any or all penalties delineated within Section 455.228(1), Florida Statutes, and/or any other relief that is authorized pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder. 7 SIGNED this /7% day of , 1999.
