Petitioner is the state agency charged with regulating the practice of dentistry pursuant to Section 20.43, Florida Statutes; Chapter 455, Florida Statutes; and Chapter 466, Florida Statutes. Pursuant to the authority of Section 20.43 (3) (g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. 2. Respondent is, and has been at all times material hereto, a licensed dentist in the State of Florida, having been issued license number DN 12853. Respondent's last known address is 12853 Meadow Bend Rd., Wellington, Florida 33414. 3. On or around November 13, 1996, Patient J.D. presented to the Respondent for dental treatment. UG Nw) 4. The Respondent misdiagnosed decay in three teeth; teeth #’s 5, 28, and 29. 5. The Respondent performed unnecessary and improper restoration of teeth’ #1s 5 > 28, 29, and 30. : | 6. On or about December 17, 1998, Patient J.D. presented to a subsequent treater to repair tooth #30. 7. The Respondent failed to meet the minimum standards of performance in diagnosis by misdiagnosing decay in three of Patient J.D.’s teeth. 8. Based on the foregoing, the Respondent’s license to practice dentistry in the State of Florida is subject to discipline pursuant to Section 466.028 (1)(x), Florida Statutes, for being auilty of incompetence or negligence by failing to meet the minimum standards of performance in diagnosis and treatment when measured against generally prevailing peer performance, including but not limited to, the undertaking of diagnosis and treatment for which the dentist is not qualified by training or experience or being guilty of dental malpractice.
