Cummings, Respondent. / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Bobby W. Cummings. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on February 26, 1990, and was issued Law Enforcement Certificate Number 59424, and on November 13, 1986, was issued Correctional Certificate Number 59425. 2. (a) On or about June 11, 1997, the Respondent, Bobby W. Cummings, did then unlawfully and intentionally commit an assault upon Blake Grasso, by threatening by word or act to do violence to said person, coupled with an apparent ability to do so, and by doing an act which created a well-founded fear in Blake Grasso that said violence was imminent, by threatening to shoot Blake Grasso with a « deadly weapon, to-wit: a handgun. rom _ (b) On or about June 11, 1997, the Respondent, Bobby W. Cummings, did then unlawftlly and intentionally commit an assault upon Gene Turner, by threatening by word or act to do violence to said person, coupled with an apparent ability to do so, and by doing an act which created a well-founded fear in Gene Turner that said violence was imminent, by threatening to shoot Gene Turner with a deadly weapon, to-wit: a handgun. {c) On or about June 25, 1997, the Respondent, Bobby W. Cummings, did then make a false statement concerning material matters to investigators of the Department of Business and Professional Regulation, Division of Alcoholic Beverage and Tobacco, with the intent to mislead said investigators regarding the commission of an Aggravated Assault. 3. The actions of the Respondent did violate the provisions of Section 943.1395(6) and/or (7), Florida Statutes, and/or Rule 11B- 27.0011(4) (a) and/or (c), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Law “Enforcement and Correctional officer in the State of Florida have good moral character. 4, This Administrative Complaint is issued pursuant to Sections 120.60, and 943.1395(6) and/or (7), Florida Statutes.” Any proceedings concerning this Complaint shall be conducted pursuant to Section 120.57, Florida Statutes, and Rule 11B-27, 28-1, 28-5, and 28-6, Florida Administrative Code. WHEREFORE, it is alleged that the Respondent, Bobby W. Cummings is guilty of violating Sections 943.1395(6) and/or (7), and/or 943.13(7), Florida Statutes, and/or Rule - 11B-27.0011 (4) (a) and/or (c), Florida Administrative Code. VY YY NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Bobby W. Cummings and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Elections of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
